What is a Fideicomiso?

It is a Contract in which a Mexican Bank obtains a permit from the Department of Foreign Affairs (SRE) to buy a property located within the restricted area, granting the use and enjoyment rights to a non-Mexican citizen.

It is also the legal, permanent and exclusive way for non-Mexican to obtain the rights of use and enjoyment of a Real State located within the restricted area.

Why do I need a Fideicomiso?

Mexican authorities limit property ownership in restricted areas such as beaches and borders. However, they grant discretionary power to the State to make it extensive to foreigners through the Mexican Department of Foreign Affairs (SRE). Therefore, if a non-Mexican wants to acquire a property in this area, he or she will have to do it through a Fideicomiso.

What is the restricted area?

It is the strip that covers the first 50 Kms. (31 Miles) of the sea coast and the first 100 Kms. (62 Miles) of the International borders.

How long is the validity of the Fideicomiso?

The Fideicomiso is valid for up to a period of fifty years and it can be renewed previous authorization of Mexican Department of Foreign Affairs (SRE), as long as the extension does not exceed that period.

What are the fees for establishing a Fideicomiso?

These are the expenses that the non-Mexican citizen has to pay the Mexican Bank, for creating the Fideicomiso. An annuity for management expenses must also be paid in advance.
The payments for the Mexican Department of Foreign Affairs (SRE) permit and the Foreign Investment National Registry (RNIE) registration, should also be considered.

Besides the fees for establishing a Fideicomiso, what other expenses have to be paid as part of the transaction?

The fees, taxes and expenses that arise from the exectution of the trust deed before a Notary Public, must also be paid.
The costs and taxes of the operation are equal to those that would be paid for a normal title transfer from one Mexican to another.
